Conditions for the supply of coal to Dutch warship vessels

The prices must be quoted in accordance with the following three conditions:

(1) Free alongside of the vessel.

(2) Put in bulk into the holds of the vessel, stowage to be done by the vessel's crew.

(3) Put in bulk into the holds of the vessel and to be stowed by the supplier.
Everything per ton of 1,016 Kilos.
Further the names of the agents at every port should be mentioned.
The supply must further take place on the following conditions:

(1) The coals will have to be best Welsh coal, same coarseness as customary in commerce and from the depot of the agent named by your firm.

(2) The extent of the requirement is not fixed. Your firm has no claim for indemnification, neither in the case that during the period of 1st January until 31st December 1901 any port is not touched at by Netherlands War or Government vessels, so that suppliers are entirely uneffected, nor in case that such vessels should not complete their coal quantity in any port. On the other hand, these vessels are compelled when completing their coal quantity in the ports named, during the period of 1st January to 31st December 1901 to take the necessary coals from the agents as directed by your firm.

(3) The supply takes place freight free and free from all dues which according to local or general ordinations, might be payable on the coals on board of the War or Government vessels which issues the order, and also to the choice of the commander, put in bulk into the holds with stowage by the crew or with stowage by the supplier or free alongside the vessel, when it has not been otherwise arranged.

(4) The supplier takes the risk of the coals supplied, until such time that they have been approved and accepted as regards quality and quantity.

(5) To state the exact quantity delivered it has to be weighed on a [cascule] or in the scale approved by both commander and supplier i.e. From every ten bags or baskets taken on board one has to be weighed and both parties shall have their turn to select one out of the ten. The quantity may also be stated by measuring, but both parties must agree before shipment of the coals as regards the stowage per cubic meter.

(6) When required by the Commander an minimum of 300 tons is supplied per working day with this understanding that the first 300 tons, if required must be brought alongside the vessel at least within 24 hours after having been notified. When several Netherlands vessels require coals simultaneously the said quantity must be supplied per working day to every vessel to a maximum quantity of 1,200 tons per working day for the several vessels.
In case the requirement exceeds 50 tons, the coals have to be supplied in at least two barges, so that the shipment can be effected on both sides of the vessel simultaneously. With a longer stay of the vessel in port it is left to the Commander to lengthen the term of shipment according to circumstances and also in that case to fix the term of shipment, taking however into consideration the daily maximum quantity before mentioned. With regard to Plymouth it is still observed that in those ports 4 and 6 days notice has to be given to suppliers, when respectively 300 / 500 and 500 / 1,000 tons coals are required.

(7) In case of difference of opinion between the commander and the supplier as regards the manner in which the supply is executed the decision is left to the Netherlands' Consul on the spot.

(8) Strikes in the mines, war or strike of labourers which may bear influence on the execution of the supply give the right to the supplier to stop or reduce the supplies according to circumstances.

(9) For the port of Plymouth the proceeding paragraph regarding strike must be read as follows:
Strike in mines, war or strike of labourers in any coal district which are of influence on the execution of the order also other circumstances beyond the control of the supplier rendering it impossible to carry out the agreement, give the supplier the right to supply coals at the price of the day only, if coals be obtainable.
(9a) In the cases referred to under 8 & 9 the commanders are dispensed with the obligation to take coals from contractors, they being unable to deliver at contract price or in the quality as prescribed under 1; the commanders are then at liberty to buy also from other suppliers.

(10) Payment will be made after approved supply against the prices mentioned without any reduction for discount against receipted accounts model n°15 in treble by means of draft on the department of Marine In the Netherlands, at ten days sight, or on the Marine department in Netherlands India or on the colonial department in the Netherlands at ten days sight or longer.

(11) In case the market price of the coals at the time of supply might be less than the price mentioned, only the market price will be paid.

(12) Amongst the vessels meant, are not included those which touch at the ports coning from the Netherlands Indies and are under the rule of the Indian government.

(13) On the coals to be supplied under this agreement, the usual commission can be paid to the Consular officials.
